Around 50 social and human rights organizations have addressed Ecuador’s Minister of Foreign Affairs, Gabriela Sommerfeld, to remind her that the massacres and famine in Gaza have reached a breaking point and that the silence and inaction of the Ecuadorian State are unacceptable.
The organizations have drawn attention to Ecuador’s obligations as a State Party to the most important international human rights instruments, particularly the Convention on the Prevention and Punishment of the Crime of Genocide and the Convention against Apartheid.
“These obligations require not only refraining from committing genocide, but also preventing and punishing it. This responsibility is immediate and binding,” they stated in an open letter.
They also noted that Ecuador is a member of the United Nations Committee on the Exercise of the Inalienable Rights of the Palestinian People and the Special Committee on Decolonization, which it has chaired on three occasions.
They also emphasized that “political protection of Israel or the cover-up of alleged Israeli war criminals directly violates these obligations.” The latter includes visits by former Israeli military personnel to Ecuador, within the framework of the “Heroes for Life” program.
Finally, they warned that “United Nations human rights experts have affirmed, following the International Court of Justice’s ruling on Israel’s illegal occupation and apartheid, that States must, at a minimum, cancel or suspend economic relations, trade agreements, and academic ties with Israel that may contribute to its illegal presence and apartheid regime in the Occupied Palestinian Territory.”
The organizations reminded the Ecuadorian Foreign Minister that these obligations are not a choice and, on the contrary, “it is a legal and moral duty to stop this genocide.”

The livestreamed genocidal horror of the constant massacres and famine induced by the Israeli apartheid regime against millions of Palestinians in the illegally occupied Gaza Strip has reached a breaking point.
Recently, some Western states complicit in this genocide have issued statements reflecting a symbolic political shift. From the Global South, we have seen concrete measures taken by a few countries, despite the clear popular consensus: Israel must be held accountable.
When thousands of Palestinian babies face death because the Israeli occupation prevents the entry of all goods into Gaza—including infant formula and essential medical supplies—the “Never Again” is now.
Most States, including our own, are far from fulfilling their legal obligations under international law, including the Convention on the Prevention and Punishment of the Crime of Genocide and the Convention against Apartheid.
These obligations require not only refraining from committing genocide, but also preventing and punishing it. This responsibility is immediate and binding.
Any continued provision of arms, fuel, dual-use supplies, military or intelligence support, political protection to Israel, or concealment of alleged Israeli war criminals directly violates these obligations.
UN human rights experts have affirmed, following the International Court of Justice’s ruling on Israel’s illegal occupation and apartheid, that States must, at a minimum:
• Cancel or suspend economic relations, trade agreements, and academic ties with Israel that may contribute to its illegal presence and apartheid regime in the Occupied Palestinian Territory; and
• Impose a comprehensive arms embargo on Israel.
We demand that the Ministry of State immediately adopt these necessary measures to fulfill our obligation of non-complicity, prevention, and punishment for the genocide perpetrated by Israel against millions of Palestinians in Gaza.
It is not a choice: it is a legal and moral duty to stop this genocide.
We demand that the Executive Branch respect this duty, rather than limiting itself to symbolic posturing, empty declarations, or, worse still, continuing to be complicit while Israel exterminates a people and destroys the foundations of international law.

Las organizaciones han llamado la atención sobre las obligaciones que tiene Ecuador como Estado Parte de los más importantes instrumentos internacionales de derechos humanos, en particular la Convención para la Prevención y la Sanción del Delito de Genocidio y la Convención contra el Apartheid.
“Estas obligaciones no sólo exigen abstenerse de cometer genocidio, sino también prevenirlo y sancionarlo. Esta responsabilidad es inmediata y vinculante”, han señalado en una carta abierta.
También han subrayado que la “protección política a Israel, o encubrimiento de presuntos criminales de guerra israelíes viola directamente estas obligaciones”. En este último caso, se incluyen las visitas de ex militares israelíes a Ecuador , en el marco del programa “Héroes para la Vida”.
Y, por último, han advertido que “expertos y expertas en derechos humanos de las Naciones Unidas han afirmado, tras el fallo de la Corte Internacional de Justicia sobre la ocupación ilegal y el apartheid de “Israel”, que los Estados deben, como mínimo cancelar o suspender relaciones económicas, acuerdos comerciales y vínculos académicos con “Israel” que puedan contribuir a su presencia ilegal y régimen de apartheid en el territorio palestino ocupado”.
Las organizaciones han recordado a la canciller ecuatoriana que estas obligaciones no son una elección y, que por el contrario, “es un deber legal y moral detener este genocidio”.

Recientemente, algunos Estados occidentales cómplices de este genocidio han emitido declaraciones que reflejan un giro político simbólico. Desde el Sur Global, hemos visto medidas concretas por parte de unos pocos países, a pesar de que el consenso popular es claro: “Israel” debe rendir cuentas.
Cuando miles de bebés palestinos enfrentan la muerte porque la ocupación israelí impide el ingreso de todos los bienes a Gaza -incluyendo leche infantil y suministros médicos esenciales-, el “Nunca Más” es ahora.
La mayoría de los Estados, incluido el nuestro , está lejos de cumplir con sus obligaciones legales según el derecho internacional, incluyendo la Convención para la Prevención y la Sanción del Delito de Genocidio y la Convención contra el Apartheid.
Estas obligaciones no sólo exigen abstenerse de cometer genocidio, sino también prevenirlo y sancionarlo. Esta responsabilidad es inmediata y vinculante.
Toda provisión continua de armas, combustible, insumos de doble uso, apoyo militar o de inteligencia, protección política a Israel, o encubrimiento de presuntos criminales de guerra israelíes viola directamente estas obligaciones.
Expertos y expertas en derechos humanos de las Naciones Unidas han afirmado, tras el fallo de la Corte Internacional de Justicia sobre la ocupación ilegal y el apartheid de “Israel”, que los Estados deben, como mínimo:
Exigimos que esa Cartera de Estado adopte de inmediato estas medidas necesarias para cumplir con nuestra obligación de no complicidad, de prevención y de sanción del genocidio perpetrado por “Israel” contra millones de palestinos y palestinas en Gaza.
No es una elección: es un deber legal y moral detener este genocidio.
